Warranty Statement

1、Shenzhen Kimtigo Semiconductor Co, Ltd. (hereinafter referred to as Kimtigo) promises to consumers or customers that Kimtigo brand products do not have defects in materials or manufacture processes;

2、Kimtigo promises that if any Kimtigo product has material or functional flaw or fault, Kimtigo is entitled to decide torepair or replace the product with equivalent product;

3、Kimtigo provides consumers or customers with repaired qualified products or new products. All returned products have been under strict test to ensure that their functions are equivalent to those of new products.


Applicable Scope
  • The warranty terms of Kimtigo apply to consumers or customers who buy Kimtigo products from Kimtigo or authorized distributors;

  • The warranty service is not transferable, and does not apply to second-hand resale products or other products purchased from unauthorized distributors. Should such products be received by Kimtigo after-sale center and verified, Kimtigo has the right to take actions, including but not limited to confiscating the products and canceling the franchise;

  • When consumers or customers make a warranty request, they must provide sufficient and necessary credentials to prove that the products fall within the warranty scope of Kimtigo.



Limited Warranty

Damage to the product caused by unnatural or external factors is not under this warranty, and Kimtigo shall bear no liability for the data stored in the product. If one of the following conditions is met, the product falls out of the warranty of Kimtigo:

(1)The product fails due to irresistible environmental factors, improper manual operations and other factors other than the product itself.

(2)Unauthorized disassembly, maintenance, and replacement of parts, changes to SPD/firmware data, and label alterations.

(3)The product label, warranty label, tamper-evident label and anti-fake label are altered, damaged or lost.

(4)The serial number of the product is nonconforming, altered, or cannot be identified.

(5)The product is purchased from distributors not authorized by Kimtigo.

(6)The product is corroded, rusted, contaminated, oxidized, or damaged in improper operation environment.

(7)The product is functionally missing or incompatible in improper environment or with improper operation method.

(8)The product is not operated, maintained, and managed in accordance with the requirements of the product 

(9)The damage of the product is caused by poor transportation conditions and other force majeure.

(10)Any accident, abuse, pollution, improper or inappropriate right protection or correction, or other external factor causes product loss.

(11)Any failure caused by computer viruses, such as third-party software, interfaces, and parts that are not supported by Kimtigo products.

(12)The product has been modified or maintained by unauthorized persons.

(13)Any appearance damage, including but not limited to scratches, plastic part fracture, metal corrosion, or other mechanical damage, unless it is found and determined to be a defect of the original material or man-made damage arising from unpacking inspection of the material.

(14) The product is an engineering sample, a sample for evaluation or non-mass production product.

With regard to the aforesaid conditions, Kimtigo has the right to decide whether to repair the product at its own discretion. Kimtigo can provide paid repair services based on the actual situation, and all costs involved (including repair fees, parts or product replacement fees, transportation fees (two-way), and insurance premium (two-way)) shall be borne by consumers or customers themselves. Consumers or customers are required to make a request to the general after-sales service center of Kimtigo through formal channels and tell the product state.


Product Warranty Service

(1) Memory products

- The limited lifetime warranty service for the "Tigo" memory products is counted from the date of sale.

- The "limited lifetime warranty" refers to one year starting from the date of discontinuity.

- For all memory products (leaded products) manufactured by Kimtigo before December 31, 2007, Kimtigo ceases the warranty service according to the requirements of environmental protection regulations and regional laws. Consumers (customers) shall stop requesting service for such products, purchase new products or apply for paid replacement service.

(2)SSDproducts

- The after-sales service for Kimtigo G5 SSD series products is five-year limited warranty, starting from the date of sale.

-The after-sales service for other SSD products of Kimtigo except G5 products is three-year limited warranty, starting from the date of sale. The specific rules are as follows:

-"Three-year limited warranty": If a product has quality problem under normal use conditions and is within the three-year warranty, after the problem is checked and confirmed by Kimtigo, Kimtigo can provide warranty service. The warranty period of the product after replacement is not changed, based on the original product warranty period.


From July 1, 2018, the warranty terms for all consumer products of Kimtigo have been adjusted and a two-way warranty policy is used. The specific rules are as follows:

Description:  

Take S300 2.5 inches 240 GB as an example. Three-year limited warranty or 80 TB can be selected. Either warranty service is up, the warranty is considered expired. If the product is used more than 3 years or the data write volume exceeds 80 TB (though within the warranty period), the product falls out of warranty.

The aforesaid warranty period starts from the date of sales or the date of manufacture. To use the warranty service, consumers shall offer credentials, for example, invoice or delivery order. The warranty period starts from the date of sales. If consumers cannot provide credentials, the warranty period is counted from the date of manufacture.

 


Precautions

(1) For a product with the storage function, back up the original data in the product before sending it for repair. For data loss or damage arising from the repair, Kimtigo bears no liability.

(2) For some products, the repair is implemented by replacement of spare parts. Therefore, the repaired product may not be the original product.

(3)For service requests for products whose warranty period expired, Kimtigo can still provide extended maintenance services based on specific conditions, and Kimtigo will determine the repair items on its own and charge for related maintenance services. For products that have been discontinued, Kimtigo will publish them on the official website from time to time ("List of Discontinued Products").

(4)Kimtigo does not support replacement of products with different capacities or specifying of chip production time.  

(5)The accessories (package, manual, drive, protective cover, USB cable, bracket, etc.) of portable hard disks and SSD products of Kimtigo are not under warranty.

(6)For the products purchased as a part of a kit, the complete kit must be returned to meet the warranty requirements. 

(7)For the product that has been repaired or replaced, the limited warranty refers to the remaining days of the warranty period of the original product or ninety (90) days after repair, whichever is longer.

(8)Customers can purchase extended warranty service from Kimtigo, authorized distributors or agents at an additional cost when they are purchasing hardware or offering product prices. This extended warranty service only applies to Kimtigo products and original hardware, excluding any parts that are not packaged by Kimtigo factories. Disclaimers

1.Kimtigo is only liable for the maintenance and testing of Kimtigo products, and does not provide backup or restoration service for the data stored in the products. Kimtigo shall bear no liability for any loss of data stored in Kimtigo products due to any factor. 

2.Kimtigo does not bear the obligation of compensating the buyer or any other third-party user for any other inevitable, indirect, and incidental losses caused by product flaws, such as loss of income, loss of business investment, loss of goodwill, or obstacles to the relationship between enterprises. Kimtigo does not assume the obligation of compensation for damages or malfunctions of other equipment caused by the products.

3.Kimtigo is not liable for product defects or damages and data loss caused during delivery of the products. Kimtigo has no obligation to keep confidential the data and information stored in Kimtigo products. You are advised to back up all data in Kimtigo products and delete the data from the products.  

4.Within the range of applicable laws, Kimtigo shall not be liable for any profit loss, expected cost loss, loss of data, or other indirect, accidental or derivative losses or damages arising from or in connection with the use of Kimtigo products.   

5.The safety design of Kimtigo products is not high. Therefore, Kimtigo does not advise that you apply the products to life-sustaining equipment or other equipment that may cause personal injury or death due to flaws or failures in the products, including but not limited to medical or related equipment, military or related equipment, aircraft, traffic control equipment, disaster prevention systems, combustion control systems, and nuclear energy equipment. If Kimtigo products are used in such applications, Kimtigo is not liable for any personal injury or loss resulting from such applications.

Miscellaneous

The aforesaid warranty terms are unique and complete, and will replace all other oral or written agreements, and they are not accompanied by any other guarantees of the merchantability or suitability of this product for specific purposes that are not stated here, either express or implied.

Sending Method

1.Deliver the goods that require warranty to the designated location of Kimtigo by express. (For large quantities of goods, employ a logistics company to send the goods to the designated logistics point of Kimtigo).

2. Kimtigo and the customer bear one-way freight, respectively. Kimtigo has the right to refuse goods freight collect.

3.The consignor pays the one-way freight and bears the loss that may occur when the goods arrive at the consignee.

4.A delivery order must be accompanied with the goods. If no delivery order is available, causing loss of the goods. The customers shall bear the loss on their own.

5.Warranty requirements vary with regions. To standardize the warranty process and provide efficient and high-quality warranty services, individuals or end customers can submit applications through authorized distributors or agents of Kimtigo to enjoy the corresponding warranty service items if they have warranty requirements. For a warranty application that is directly submitted by any individual or end customer to Kimtigo, Kimtigo has the right to reject it.

6.Site access and assistance. If site services are stipulated in the agreed service level agreement (SLA), the customer shall provide sufficient permission to access its equipment and supporting products. This permission includes sufficient working space, electricity, and troubleshooting devices, such as a screen, a keyboard, and a mouse.

7.Cell phone/remote troubleshooting service on site. The customer agrees to provide Kimtigo with all necessary information so that Kimtigo performs remote fault testing and determines the required payment level.

8.Data backup. Customers are advised to back up data on a regular basis, especially before Kimtigo provides return authorization. Kimtigo does not assume any liability for the loss of personal information, procedures or portable media.
